Understanding Dog Attacks

Generally speaking, a person will be entitled to claim compensation for personal injuries sustained as the result of a dog attack.

Pursuant to the Dog Act 1976, Section 33D

 
“If a dog attacks or chases any person or animal and physical injury is caused to the person or animal that is attacked or chased, every person liable for the control of the dog commits an offence”. 


In other words, there is strict liability for the actions of a dog placed upon the owner/person in control of that dog.

Pursuant to Section 46 of the Dog Act 1976



“The owner of any dog…shall be liable, subject to any contributory negligence, in damages for:

(a)  injury to any person or animal inflicted; or

(b)  damage to the property of a person caused,

 

in the course of an attack by that dog.”


Generally, if a dog owner has a home contents insurance policy, that policy will cover the actions of the dog. However, this is not always the case. Alternatively, a claim for criminal injuries compensation may be submitted if the dog owner is convicted of an offence.
